Informative letter according to the Legislative Decree No. 196 of 06/30/2003 "Data Protection Code"

In accordance with Art. 13 of Legislative Decree No. 196 of June 30, 2003, we inform you that our company named in the imprint processes the personal data of customers and suppliers, as well as persons who voluntarily provide their personal data to our company (by telephone, fax or by email).

As well as persons whose data has been taken over by third parties, for example when collecting external data for business information, public directories, etc., whereby in the latter case it is exclusively personal data of a common / common type and nature.

Our company guarantees within the framework of legal requirements that the processing of personal data takes place in consideration of the fundamental rights and freedoms as well as the dignity of the person concerned with special reference to confidentiality, personal identity and the right to protection of personal data.

Objectives and purposes of data processing

  • Fulfillment of legal obligations, obligations from ordinances, community norms as well as civil and tax laws

  • Fulfillment of possible contractual obligations towards the person concerned

  • Fulfillment of activities in connection with the business activities of our company such as filling in internal statistics, for accounting as well as for keeping customer / supplier accounting

With regard to the objectives specified above, your personal data will be forwarded if necessary:

  • to the public administrations and authorities, if this is provided by law

  • to credit institutions with which our company maintains business relationships for the administration of receivables / liabilities and for financing brokerage

  • to all those natural and / or legal, public and / or private persons (legal, administrative and tax consultancy offices, courts, chambers of commerce, etc.), if the forwarding proves to be necessary or expedient for the performance of our activities and in the manner specified above and ways with the appropriate objectives

The personal data processed by our company are not subject to any dissemination.

The data processing can take place with or without the help of electronic, in any case automatic, means and includes all procedures provided for in Art. 4, Paragraph 1, Letter a of Legislative Decree No. 196 of June 30, 2003 and required for the relevant data processing. In any case, the data processing is carried out in compliance with all security measures that guarantee their security and confidentiality.

The Data Protection Act gives those concerned the opportunity to exercise certain rights in accordance with Art. 7. In detail, they have the right to know what personal data the owner has about him and to receive information about whether data about him are available, even if they are not yet are stored and to find out more information about this data, origin and the reason and purpose of their processing in an understandable form, as well as information about the owner and person responsible for processing and persons and categories of persons to whom this data may be transmitted. The person concerned has the right to confirm and check, correct and supplement his data, to request that the data be deleted, blocked and converted into anonymous data if the processing violates the legal provisions. He has the right to oppose the processing of his data in whole or in part for a justified reason, as well as to request its deletion, blocking, conversion into anonymous data and without justified reason if data for the purpose of commercial information, the sending of advertising material, direct sales , to be used for market and opinion research.

Note on the evaluation of the statistical data

General Terms and Conditions (GTC) – Tandem Paragliding

1. Scope These General Terms and Conditions (GTC) apply to all contracts for tandem paragliding flights concluded between Tandem-Fly (hereinafter referred to as "Provider") and the customer (hereinafter referred to as "Passenger"). By booking a tandem flight, the passenger accepts these GTC as binding.

2. Services Tandem-Fly offers the brokerage and organization of tandem paragliding flights with professional, state-licensed tandem pilots. The execution of the flight itself is the sole responsibility of the respective pilot.

3. Participation Requirements • Body weight: between 20 kg and 120 kg • Minimum age: 4 years

(under 18 years only with written consent from a parent or guardian) • No
health restrictions (e.g., cardiovascular diseases, epilepsy,
pregnancy, etc.) The passenger is obligated to provide truthful information about their
state of health.

4. Weather and Safety Conditions Tandem flights are weather dependent. The pilot decides alone whether to conduct, postpone, or cancel a flight for safety reasons. In the event of a weather-related cancellation, an alternative date will be offered. A refund is only available if no alternative date is possible.

5. Cancellation by the Passenger • Free cancellation up to 24 hours before the flight. • From 24 hours before the flight or in case of no-show: full price is due. • A substitute passenger may be named, provided they meet the participation requirements.

6. Cancellation by the Provider The provider may cancel a flight due to adverse weather conditions, force majeure, or organizational reasons. An alternative date will be offered.

Further claims against the provider are excluded.

7. Responsibility and Liability: Tandem-Fly acts solely as an intermediary and organizer
of tandem flights. The actual flight is conducted entirely and independently by the respective pilot, with full legal, technical, and liability responsibility. Tandem-Fly is not liable for damages or accidents that occur during the flight. Responsibility and liability for the flight and the passenger's safety lie solely with the pilot conducting the flight – regardless of where or through whom the flight was booked or paid.

The passenger acknowledges that: • the pilot acts independently, • the passenger undertakes the flight at their own risk, • and all decisions regarding the flight route, takeoff, safety, and landing are the responsibility of the pilot.

8. Insurance: All tandem pilots employed have the legally required aviation liability insurance. Additional accident insurance is not included and is the responsibility of the passenger.

9. Photo and video recordings If photo or video recordings are made during the flight,
the passenger agrees to their use for private or advertising purposes by
Tandem-fly – unless expressly objected.

10. Vouchers Vouchers are valid for two years from the date of issue. After this period, redemption is only possible by prior arrangement and subject to an additional charge. Cash payment is not possible. Redemption is only possible by prior appointment.

11. Jurisdiction and Applicable Law The laws of the Italian Republic shall apply exclusively. The place of jurisdiction is, to the extent legally permissible, the registered office of the provider.

12. Severability Clause Should any provision of these Terms and Conditions be or become invalid in whole or in part, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a provision that most closely approximates the intended economic purpose.
